Application for asylum

During the border control when entering the Republic of Serbia or on the territory of the Republic of Serbia, an alien may verbally or in writing, before an authorized police officer of the Ministry of Interior (MoI) express their intention to apply for asylum. Exceptionally, an alien may express their intention to apply for asylum in the asylum center, in another facility designated for the accommodation of asylum seekers, as well as in the shelter for aliens.

An alien who has expressed an intention to apply for asylum shall immediately after expressing their intention be registered and be referred to an asylum center or other facility designated for the accommodation of asylum seekers to which they must report within 72 hours after the registration confirmation has been issued. An authorized police officer, in order to register an alien, will take a photo and will take their fingerprints. Fingerprints shall not be taken from a minor for whom it can be reliably or unambiguously determined to be under 14 years of age. An alien who has a passport, identity card (ID) or another identification document, residence permit, visa, birth certificate, travel card, or another document relevant to the asylum procedure, is obliged to submit them during registration.

The authorized police officer of the Ministry of the Interior (MUP) shall issue a confirmation of registration of the alien who has expressed the intention to submit an asylum application (hereinafter: registration confirmation). During the admission of an alien who has been issued a registration confirmation in an asylum center or other facility intended for the accommodation of asylum seekers, the Commissariat for Refugees and Migration (KIRS) confirms the admission in the registration confirmation.[1]
